Hi Prasenjit,

Tell Them Seller Defaulted & There Should Have Been An Auction & The Benefit Of The Penalty Auction Was To Be Yours....

Also...Tell Them Through Email...That You Are Lodging A Complain Against Them & That You Are Aware Of This As Frequent Occurence Through Many Of Their Clients Who Are Your Friends & There Other Malpractices On Their Clients For Liquid BTST.

Hi Savant Sir,

Today the share is credited to my account. They didn't provide me any contract note for the auction.Shall I ask for the contract note today or i shall wait for tomorrow?

Hi Savant Sir,
I wrote an email to them..The mail goes as follows.

--------------------------------------------------------------
Dear Sir,

Myself Prasenjit Saha (customer ID: xxxxxx).I had a short delivery of 10 shares of Ksk Energy Ventures Ltd .So as the seller defaulted there should have been an auction & I am entitled to get the benefit of the penalty leived on the seller.
So I am lodging a complain against sharekhan for Maplpractices & pocketing the benefit on their clients for liquid BTST.
Please reply as soon as posible.

I am waiting for their reply after that I will notify you.

Looks Like Similar Story Happened With Me Few Months Back Where You Gave A Great Helping Hand. In The Whole Event I Learned "Asking For Contract Note" Is Key, Where Broker Become Nervous And Result Most Of The Time Is ReFund.

Thanks.:)

Hi Prasenjit,

BTST Is Another Story...Has Nothing To Do With Your Purchase...So Remove BTST Bit From It...Correct Of The Spelling Mistakes In It.

Also Mention That You Are Lodging Complaint With NSE

Hi savant Sir,

A lady from sharekhan called me today and asked me the whole matter. When i told her that I am entitled to get the benefit from the auction which levied on the seller, she told me that there is no auction occurred in this case. This is just a short delivery not short sell problem.I told her as per my knowledge there should be an auction occurred in this case and i need the contract note for the auction, she told me that the auction occurred in the seller side.so i can't get the contract note.I told her that I am going to lodge a complain against sharekhan on Malpractices.
she told me to please wait for some time..she will get back to me shortly..
I am waiting for her call and also your reply on the whole conversation.

Sir, can you explain me please what is the benefit in that case?

Tell Her True, There Would Be An Auction On The SELLER Because He Defaulted In Delivery & You Happen To Be The Other Side Of The Trade....Meaning BUYER Therefore You Are Entitled To Closeout & Benefit Of The Penalty.

I got a mail from sharekhan about this issue..the mail is:

Dear Mr. Prasenjit Saha ,

Thank you for writing in.

We would like to inform you that you have purchased 10 shares of KSK energy on 24/09/2009 but 10 shares were short from exchange and thus the same is not delivered in your demat account .

Further the shortage is settled within Trading + 4 working days and after the settlement either the shares or the credit for the same is given in your account .Kindly check your account accordingly.

We would like to inform you that net purchases made in any Scrip by you will be credited to your Demat Account. Shares are available for credit as per the settlement schedule of the exchanges, after the full payment is made to the clearing house of the exchange.

Sometimes, the clearing house may not be able to deliver the full quantity expected. In such cases, the exchange will try to buy the short delivery by conducting an auction, resulting in a delayed delivery into your Account, or will force a close-out and credit the money into your Account, if delivery cannot be arranged even through an auction process.

Sometimes it may also happen that the clients buying/selling obligation result in internal obligation because of the Exchange method of settling trades on net obligation at the broker level. If any selling client fails to deliver the required securities and due to this buyer does not get the security in payout then we may buy such short shares.

Kindly feel free to revert in case of any further clarifications.

----------------------------------------------------------------------

Now what shall I do?
