I have certain questions regarding taxation on shares transactions. I am a regular trader; i.e. buying and selling shares on same or different day, buying and selling futures and options on either same or different day.
I would like to learn how a transaction is determined to be long term capital gain, short term capital gain, speculation profit, or trading profit?
I am presenting various scenarios and I would like to learn about the tax implications on the same.
The scenarios are:
1. If I buy delivery based shares and sell them after 5 days.
2. If I buy delivery based shares and sell them after 2 months.
3. If I buy delivery based shares and sell them after 1 year.
4. If I buy shares and sell them on the same day.
5. I buy future lot and sell on the same or later date.
6. I buy nifty option [call or put] and sell on same day or later date.
Please let me know how you would classify the tax segment for each point above.
Another question is how do I judge whether the shares transactions done by me are business or investments. Since I do share trading on daily basis, including delivery based, futures, and options , would all my transactions be deemed as business transactions and be levied a tax of 33%?
